$1 Million Settlement After Florida Teen's Shooting Death by Police

Delray Beach, Florida residents Kenneth Miller and Terry Glover brought a § 1983 action against the city and rookie policeman Barren Cogoni for negligence and excessive force after Cogoni shot and killed Jerrod Miller in 2005. The suit settled for $1 million.

Cogoni was assigned to a security post at the Delray Full Service Center school dance in 2005. Jerrod Miller, 16, approached the entrance to the dance in someone else’s vehicle while driving without a license. When Cogoni asked for his identification Miller drove away and the vehicle entered school grounds, heading toward the gym and several students. Cogoni began shooting at the vehicle, resulting in one fatal shot to Miller's head. The suit alleged that the city condoned policies which led to the excessive force and Miller's subsequent death.
