Oklahoma Man Rejects $10,000 Settlement, is Awarded $424 for Jail Assault

An Oklahoma man rejected a $10,000 settlement offer and was awarded $423.97 for a jail assault.

The plaintiff, Lloyd Wayne Dowler, 31, was confined in a Tulsa County jail in May 1981 for Driving Under the Influence (DUI) when he was assaulted by a police officer. He sustained cuts on his head and two broken teeth.

Dowler sued in state court. The defendants offered to settle for $10,000, however Dowler rejected the offer and proceeded to trial in March 1988. A verdict was returned in his favor but he was awarded just $423.97 for past medical expenses. See: Dowler v. Hayes, Tulsa County District Court (OK), Case No. CJ-1984-5569.
