$15,000 Settlement for Pennsylvania Jail Prisoner Injured by Guard

Pennsylvania’s Luzerne County Council agreed to pay $15,000 to settle potential litigation from a former jail prisoner who was injured by a guard at the Luzerne County Jail (LCJ).

The settlement stemmed from a May 5, 2012 event incident at LCJ. It was alleged by former prisoner John Rosengrant, 41, that guard Barry Cairl stomped on his foot, causing him injury. Rosengrant secured the services of attorney Barry H. Dyller.

Rather than take the matter to court, Dyller filed a claim with the county solicitor. Several guards corroborated Rosengrant’s version of events; the guards had even filed reports on the matter.

Cairl was terminated by LCJ, costing him an annual salary of $43,736.42. On January 22, 2013, the County Council voted to approve the settlement. While Rosengrant resolved his claim, he is still awaiting sentencing on a drug charge that could land him back in LCJ.
