$500 Settlement on Prisoner’s Negligence Suit

The eastern district of California paid $500 to settle the lawsuit of prisoner Michael R. Holtsinger for injuries sustained by being assaulted while at recreation yard at High Desert State Prison.

While at recreation on June 22, 2002, Holtsinger and his roommate were assaulted by other inmates. After the assault, Holtsinger asked for medical treatment for his injuries but received no treatment, even though he had two large abrasions on his knees, possible broken ribs, injuries to his back and shoulder, contusions to his right eye, a split upper lip and multiple lumps on his forehead and scalp.

His complaint alleged medical negligence and deliberate indifference in that medical staff did not treat him until August 20, 2002, 55 days after the incident. Holtsinger accepted settlement on March 29, 2010, acting pro se.
