$10,000 Settlement in DC Guard’s Assault on Prisoner

The District of Columbia (DC) paid $10,000 to settle a lawsuit filed by prisoner Leonard Day for injuries sustained due to a guard assaulting him.

While at the DC Jail on December 25, 1998, Day was severely beaten by a guard. The details of the incident are not available, but Day suffered a broken nose and injuries to his hands and eyes.

The complaint alleged negligent supervision and training of staff, negligent care at the DC hospital, assault and battery, and negligence in the use of excessive force.

Day accepted settlement on May 14, 2001. He was represented by Washington DC attorney Douglas R. Sparks. See: Day v. District of Columbia, Superior Court, District of Columbia, Case No. 99-4106.
