$22,500 Settlement for CCA Prisoner Assaulted by Warden

$22,500 Settlement for CCA Prisoner Assaulted by Warden

by David M. Reutter

Corrections Corporation of America paid $22,500 to settle a lawsuit seeking redress for a warden’s assault of a prisoner following a riot in the chapel at Hardeman County Correctional Facility.

A small riot broke out at the prison’s chapel on May 16, 2007 between prisoners, facility employees and other parties. Prisoner James Ingram, who was near the chapel, overheard the commotion. To demonstrate a spirit of surrender and cooperation, he complied with prison rules and fell to the floor into a fetal position.

Once the altercation was over, Ingram was directed to a back room and interrogated about who was involved in the fracas. Upon stating he had no information to provide, Warden Glen Turner grabbed and restrained him, subsequently hitting him in the left eye. The assault caused a visible cut above the eye. Ingram was transferred to segregation and denied medical treatment.

Turner told Ingram he was “going to see to it that he would be ‘maxed out.’” He was then transferred to the West Tennessee State Penitentiary without a hearing. Turner was subsequently prosecuted for the assault and pleaded guilty to the charges.

Ingram agreed to the settlement on October 26, 2010. He was represented by attorney Glenwood Roane. See: Ingram v. Turner, U.S.D.C. (W. D. Tenn.), Case No. 2:07-cv-02798.
